Notice of Intent to Adopt New Rules

NOTICE IS HEREBY GIVEN that the Board of Trustees of Campbell County School District

Number One, State of Wyoming, ("District" or “School District), intends to adopt Rule: Policy 5153 Complaint Procedures, pertaining to Complaint and Hearing Procedures for Parental Rights, subject to the terms, conditions and limitations prescribed by state law. Policy 5153

The date of public notice is June 13, 2024.  The comment period will end on July 29, 2024. The name and contact information of the contact person for Campbell County School District Number #1 is Melanie Syltie, 1000 West 8th Street, P.O. Box 3033, Gillette, WY  82717, (307) 682-5171; msyltie@ccsd.k12.wy.us. This is also the contact information for the District.

Rule Policy 5153 Complaint Procedures is authorized by W.S. §21-3-135 and W.S. 21-3-110(a)(xlii). The District has prepared a copy of the proposed rule.

The proposed rule complies with the requirements of W.S. 21-3-135.  The proposed rule creates a complaint process for individuals who believe the School District has violated the Parental Rights Policy.  The rule allows parents who believe the School District has violated the Parental Rights Policy to file a complaint with the Superintendent.  If the parents are not satisfied with the response from the Superintendent, the rule allows them to appeal to the Board of Trustees.  If the parents are not satisfied with the response of the Board of Trustees, they may appeal to the District Court.

 

The principal reason and purpose for the proposed rule is to comply with the requirements of W.S. 21-3-135 and to establish a process for parents and guardians to file a complaint if they believe the School District violated the Parental Rights Policy with respect to their student.  The proposed rule meets the minimum substantive state statutory requirements. The rule establishes a process and deadlines for parents to file a complaint with the School District superintendent if they feel the District has violated their rights under the District’s Parental Rights Policy. The rule allows parents to appeal the decision of the Superintendent to the Board of Trustees of the District.  The rule also allows parents to appeal the decision of the Board of Trustees to the District Court.

 

Campbell County School District No. One has complied with the requirements of W.S. 9-5-304.  Interested persons may obtain a copy of the assessment used to evaluate the proposed rule pursuant to this statute at 1000 West 8th Street, Human Resources Department.

 

A copy of the proposed rule the Board intends to adopt; the statement setting forth the principal reasons for the adoption of these rules; and all documents referenced herein may be obtained as follows:

Interested persons may present data, views or arguments regarding this intended action as follows:

Written submissions of data, views or arguments regarding this intended action shall be signed by the person who submits them, and must be received in the District Administrative Office no later than 4:00 p.m. on July 29, 2024, the final day of the comment period.

 

A public hearing will be held if requested by 25 persons, a government subdivision, or by an association having not less than 25 members. Requests for a public hearing may be submitted electronically to msyltie@ccsd.k12.wy.us, or in writing to Melanie Syltie, 1000 West 8th Street, Gillette, Wyoming 82717.

 

In addition, two public hearings have been scheduled for June 13, 2024 and July 11, 2024. These public hearings will take place at 1000 West 8th Street, Gillette, Wyoming at 4:00 pm in the Board Room of the Educational Services Building.

 

Any person may urge Campbell County School District Number One not to adopt the rule and request Campbell County School District Number One to state its reasons for overruling the consideration urged against adoption. Requests for an agency response must be made prior to, or within thirty (30) days, after adoption of the rule electronically to msyltie@ccsd.k12.wy.us, or in writing to Melanie Syltie, 1000 West 8th Street, Gillette, Wyoming 82717.

 

The Board of Trustees will consider all written and oral submissions with respect to the adoption of the proposed rule. The Board intends to act to adopt this rule at their regular  board meeting on  August  27, 2024 beginning at 6:00 pm, located at 1000 West 8th Street, Gillette, Wyoming 82717 after the expiration of the comment period and after the Board has considered all written and oral submissions with respect to the adoption of the proposed rule.
